§ 1 Scope

§ 2 Service Description

MyMilo is a gamified, evidence-based exercise therapy app for patients in pediatric oncology. The app offers playful exercises and training sessions developed by doctors, medical students, and physiotherapists. The content is designed to support exercise therapy and is regularly updated.

§ 3 Usage Requirements

The app is designed for patients aged 6 to 22 and should be used under medical supervision. For minor users, parental or guardian consent is required. Usage requires a compatible device and an internet connection.

§ 4 Medical Disclaimer

The MyMilo app does not constitute medical advice, diagnosis, or treatment. The app does not replace professional medical care. Users should always consult their treating physician before starting exercises. While the exercises are evidence-based, individual health conditions must be assessed by medical professionals. If discomfort occurs during use, stop the app immediately and seek medical advice.

§ 5 Limitation of Liability

Herotion GmbH is only liable for damages caused by intentional or grossly negligent conduct. Liability for slight negligence is excluded unless essential contractual obligations (cardinal obligations) are breached. In case of breach of cardinal obligations, liability is limited to foreseeable, contract-typical damages. This limitation of liability does not apply to damages to life, body, or health.

§ 6 Intellectual Property

All content of the app and website – including text, graphics, images, animations, software, and design – is protected by copyright and is the property of Herotion GmbH. Reproduction, editing, distribution, or any form of exploitation beyond the limits of copyright law requires prior written consent from Herotion GmbH.

§ 8 Changes to Terms

Herotion GmbH reserves the right to amend these Terms and Conditions at any time. Changes will be published on the website. By continuing to use the app after publication of changes, you accept the updated Terms and Conditions.

§ 9 Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes is Tübingen, provided the user is a merchant or has no general place of jurisdiction in Germany.
